Waiver and Release of Claims and Liability

In consideration of being allowed to participate in any way in the Fleet Feet Hattiesburg Training Program, its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that: The risk of injury from the activities involved in this program is significant, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury or death does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the coaches for Fleet Feet Hattiesburg immediately. I understand Fleet Feet Hattiesburg is an independent licensee of Fleet Feet, Incorporated and independently operates this training program. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless AUGST, LLC d/b/a Fleet Feet Hattiesburg, FFSDC, d/b/a FLEET FEET, their agents, employees, coaches, volunteers, officers, directors, franchisers, successors and assigns, and any and all sponsors, their representatives and successors ("Releasees"), with respect to any and all injury, disability, death, or loss or damage to person or property associated with my presence or participation, whether arising from the negligence of the releases or otherwise, to the fullest extent permitted by law. I attest that I am in good health and physically capable of participating in the Training Program, and my medical care provider has approved my participation. Further, I hereby release, consent to, and authorize, in advance, any such use of my name, photograph, voice or likeness by the foregoing parties in any manner they deem appropriate and necessary without remuneration to me.

During much of the fall, winter, and early spring we host training runs and walks in low-light conditions. It is absolutely mandatory that every runner and walker wear some type of reflective accessory or apparel item AND some type of light. Part of being a responsible and self sufficient runner or walker is having the correct gear to keep you safe in all visibility conditions. We consider that correct gear to be BOTH reflectivity and lighting. Your safety is always our number one priority.

We will cancel group training sessions if the following weather related dangers are present: If extreme cold and/or wind If actual temperature is 15 degrees Fahrenheit or below If windchill temperature below 0 degrees Fahrenheit, If thunderstorms with lightning present, If ice storms, hail storms, extremely low visibility We will NOT cancel group training sessions if it is simply raining or snowing under typical seasonal conditions. You never know what you will get on race day, so let's be prepared for anything!

We will cancel group training sessions if the following weather related dangers are present: If extreme heat - heat index in excess of 100 If thunderstorms with lightning present If high winds or tornado warnings If hail storms, dust storms, extremely low visibility

We will post a "Wait & See " status on Final Surge when bad weather is forecasted but not certain (i.e. afternoon thunderstorms) Please understand that under this status we will still host the group training session but it may be canceled at anytime during or approaching the session if the weather worsens. We respect everyone's ability to plan their days, so we will try to use this policy as little as possible. Our goal is to make a call one way or another by 5:00PM on every training day.

If for a medical or personal reason you are unable or unwilling to continue training within the first 3 weeks of the program we will be happy to issue you a full refund for the program. Although this does not include any processing or admin fee's associated with our registration provider site. Full refunds can take up to a week to process back onto a credit card. Our overall goal is your safety and smart training, and we would love for you to participate in any of our future programs when you are back able and willing. In the event of unforeseen circumstances (act of God, worldwide pandemic) we reserve the right to take training from in person to a virtual platform immediately. Refunds will not be available as these are circumstances we cannot control.
